Residents suffer nursing home injury from accidents in a wide variety of ways. Federal regulations charge nursing homes with responsibility for keeping the facility free of hazards and for providing residents with adequate supervision and assistance. This expresses the basic promise that nursing homes make when they take residents in: that they will keep your mother or father safe.
The federal regulation provides:
Accidental Injury (482.25(h)) (h) Accidents. The facility must ensure that-- (1) The resident environment remains as free of accident hazards as is possible; and (2) Each resident receives adequate supervision and assistance devices to prevent accidents.
